Job Purpose:

To efficiently and effectively manage and control the contractual and commercial activities of the Prime Contract (and other contracts) and in particular aspects as they relate to potential exposure to contractual claims and disputes associated with the design, engineering, licensing, procurement, construction testing and commissioning of the BNPP project under the Prime Contract and other related contracts to ensure both ENEC and Barakah One Company (BOC) commercial interests are secured and risk exposure is minimized.

Activity: Prime Contract (and other Contracts) Analysis of Contractual Obligations and Entitlement


Support and work collaboratively with Commercial team to integrate and streamline Claims Management with Change Management.
Provide contractual and commercial advice to Commercial team for Change and Claims related issues on a regular basis.
Conduct extensive, detailed contractual and commercial analysis of issues which may, or already have, cost and/or time impact.
Ability to conduct analysis to determine extent of culpability of each Party and advice on contract/commercial risk to technical staff in a timely, concise manner.

Activity: Claims and Dispute Resolution


Ability to work independently on contentious and claim related matters.
Ensure potential claim issues are being commercially controlled.
Ensure ENEC commercial interests are best protected by minimizing potential for claim issues arising.
Ensure defense mechanisms are in place to minimize risk of claims and disputes being pursued by Contractor.
Identify and prepare of Owner initiated claims and/or development of counter-claims.
Negotiate of claims with Contractor.

Activity: General Commercial and Contractual Issues


Familiar with and application of Contractual obligations of both Parties by reference to terms and conditions.
Discussion and negotiation of contentious issues with a view to ensuring a non-adversarial resolution.
Provide regular concise internal reporting of Claims and Dispute Resolution issues relating to Prime Contract.
Liaise with external consultants to ensure timely deliverables are achieved.
Liaise with internal subject matter experts to understand, analyse and process schedule-related issues.
Train and mentor junior staff (including Emirati’s) on forensic schedule analysis.

Activity: People Management


Manage the effective achievement of organization’s objectives by setting individual targets, developing and motivating staff, provision of formal and informal feedback and appraisal – in order to maximize subordinate and department performance.
Contribute to the development of UAE National employees in a manner which supports the objectives of the corporation and its Emiratization strategy.
Contribute to knowledge dissemination/sharing in a way that assists with building internal capabilities of UAE Nationals where applicable and maximize their effective performance.

Activity: HSE, Security & Continuity of Operation


Follow all relevant company’s HSE policies, processes, procedures and instructions to ensure HSE compliance in all aspects of work in accordance with sound management practices by applying these HSE policies and procedures to self and others to take reasonable care for the health and safety of people, or the environment, who are at the employee’s place of work who may be affected by the employees acts or omissions at work.
Follow all relevant Security policies, processes, procedures and instructions to ensure security compliance in all aspects of work, by applying them on self, others and Corporate assets.
Ensure compliance with corporate requirements for adherence to policies, procedures and instructions related to Crisis Management and Business Continuity in order to continue mission-critical activities.

Bachelor’s degree in Quantity Surveying, Engineering, Construction Management or similar.
Minimum 5 years of relevant experience in construction industry with exposure to construction claims. Previous experience of arbitration or other alternative dispute resolution process.
